By accessing or using the Yapture website and any Yapture application, client, API, or related feature that we make available (collectively, "the Services"), you agree to be bound by these Terms of Service ("Terms"). Product descriptions and previews are not representations that a feature is publicly available. See release status for current availability. If you disagree with any part of these Terms, you may not access the Services.

These Terms apply to all visitors, users, and others who access or use the Services. The Services are owned and operated by Capswan Studio LLC ("Company," "we," "us," or "our").

Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, revocable license to use the Services for your personal or business use.

You retain ownership of any content you submit through the Services ("User Content"), including yaps, lists, attachments, comments, and chat messages. By submitting User Content, you grant us a worldwide, non-exclusive, royalty-free license to use, reproduce, modify, and distribute your content solely for operating and improving the Services.

Yapture does not currently offer a verified paid production plan or accept production subscription payments. If paid Services are introduced, the price, billing period, cancellation terms, and any additional purchase terms shown at checkout will apply to that purchase.

Subscriptions

Any future recurring subscription will continue until cancelled under the terms disclosed at purchase. Refunds and cancellation timing will be governed by those disclosed terms and applicable law.

Payment Processing

If payment processing is enabled, it may be handled by a third-party payment processor. We do not intend to store full payment-card numbers. The processor's terms and privacy notice will also apply.

7. Intellectual Property

Our Property

The closed-source portions of the Services and their original content, features, and functionality are and will remain the exclusive property of Capswan Studio LLC and its licensors. The Services are protected by copyright, trademark, and other laws. Our trademarks may not be used without our prior written consent.

Open-Source Components

Yapture publishes several components under permissive open-source licenses (see each repository for the applicable license). Use of those components is governed by their respective licenses.

OAuth clients and automated agents are subject to scope restrictions, rate limits, and audit logging. You are responsible for the actions of any agent you authorise. You may not authorise an agent that violates these Terms or attempts to bypass rate limits or scope checks.

We may terminate or suspend your account immediately, without prior notice or liability, for any reason, including breach of these Terms. Upon termination, your right to use the Services will cease immediately. You may export your data at any time before termination.
